Citadel Atelier is an independent art house creating and offering contemporary artwork, limited Museum Editions and related products.

Throughout these Terms, “Citadel Atelier,” “we,” “us” and “our” refer to Citadel Atelier and, where applicable, the business entity operating the Citadel Atelier store.

“You” and “your” refer to the person accessing our website or purchasing products or services from us.

You may use the Citadel Atelier website for lawful personal and commercial purchasing purposes in accordance with these Terms.

You agree not to:

• Use the website for unlawful or fraudulent purposes
• Attempt to interfere with the security or operation of the website
• Introduce malicious code or other harmful technology
• Scrape or systematically extract website content without permission
• Misrepresent your identity or payment information
• Use Citadel Atelier content in violation of our intellectual-property rights

We may restrict or terminate access where we reasonably believe the website is being misused.

Citadel Atelier offers artwork in professionally produced and framed editions. Product pages describe the artwork, available sizes, frame configurations and other relevant characteristics.

We make reasonable efforts to present our works accurately. However, the appearance of colors, texture and scale on a digital display may vary depending on your device, monitor settings, brightness and viewing environment.

Minor differences between a digital representation and the physical artwork that result from normal display or production characteristics do not necessarily constitute a defect.

Unless expressly stated otherwise, Citadel Atelier Museum Editions are released in a strictly limited edition of 100 worldwide.

Once the authorized edition has been fully collected, Citadel Atelier intends to retire that edition from ordinary sale and not issue a second edition represented as part of the same limited release.

Edition numbering refers to the authorized edition of the artwork and does not necessarily correspond to the chronological order in which individual works are purchased, produced or delivered.

Where specified on the product page, a Citadel Atelier Museum Edition includes a Certificate of Authenticity documenting information associated with the work and its edition.

Certificates may be issued electronically or in another format determined by Citadel Atelier.

A Certificate of Authenticity does not transfer copyright, reproduction rights, trademark rights or other intellectual-property rights in the underlying artwork.

Citadel Atelier framed works are generally made to order. Production begins after an order has been received and accepted for fulfillment.

Your selected artwork, size and frame configuration may therefore be produced specifically for your purchase rather than taken from finished retail inventory.

This made-to-order model affects cancellation, modification and change-of-mind return eligibility as described in our Returns & Refunds Policy.

Submitting an order does not necessarily mean that we have accepted it. An order is subject to payment authorization, product availability, fraud screening and our ability to fulfill the order.

We reserve the right to decline or cancel an order before fulfillment where reasonably necessary, including because of:

• Pricing or listing errors
• Suspected fraud or unauthorized payment
• Product or configuration unavailability
• Technical errors
• Delivery restrictions
• Duplicate or clearly erroneous orders
• Violation of these Terms

If we cancel an order after payment has been collected and no amount is otherwise lawfully due, the applicable payment will be refunded.

Prices are displayed on the website in the currency indicated at the time of purchase.

We may change prices at any time before an order is placed. A later price change does not ordinarily alter the price of an order already accepted.

If an obvious pricing, technical or listing error occurs, we reserve the right to correct the error and, where appropriate, cancel the affected order and refund the amount paid.

Payment must be made using an accepted payment method presented at checkout.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your order.

Payment transactions may be processed by independent payment service providers and may be subject to additional fraud-prevention and verification procedures.

Citadel Atelier may occasionally offer promotional pricing, launch offers, collector privileges or discount codes.

Promotions may be subject to separate eligibility requirements, expiration dates, exclusions and other conditions displayed with the relevant offer.

Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash or applied retroactively to completed purchases.

We reserve the right to correct, suspend or withdraw a promotion in cases of error, misuse, fraud or circumstances that materially affect its intended operation, subject to applicable law.

Production and delivery estimates are provided for guidance and are not guaranteed arrival dates unless we expressly state otherwise.

Delivery can be affected by production requirements, destination, carrier operations, customs, weather, public holidays and other circumstances outside our direct control.

Complete shipping terms, estimated delivery windows and international shipping information are set out in our Shipping & Delivery Policy, which forms part of these Terms.

International shipments may be subject to customs procedures, import duties, taxes, brokerage charges or other assessments imposed by the destination jurisdiction.

Unless expressly stated otherwise during checkout, such charges are the responsibility of the recipient.

You are responsible for ensuring that products ordered from Citadel Atelier may lawfully be imported into your destination.

You are responsible for providing accurate and complete shipping information.

Contact us immediately if you discover an address error. We will make a reasonable effort to correct the information before fulfillment has progressed, but changes cannot be guaranteed after production or shipment begins.

Additional costs arising from an incorrect or incomplete address, refused delivery or other customer-supplied delivery error may be the customer's responsibility where permitted by law.

Because our framed works are made to order, cancellation requests should be submitted immediately after purchase.

We will make a reasonable effort to stop production if possible, but we cannot guarantee cancellation once an order has entered production.

Mandatory cancellation or withdrawal rights provided by applicable consumer law remain unaffected where they apply.

Our rules concerning damaged works, defects, incorrect products, cancellations, replacements, refunds and change-of-mind requests are described in our Returns & Refunds Policy.

That policy forms part of these Terms and should be reviewed before placing an order.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer-protection law.

If an artwork arrives damaged or materially defective, you must provide sufficient information for us to investigate the claim, including photographs where reasonably requested.

Please retain the artwork, packaging and shipping materials until the matter has been reviewed.

We may require reasonable evidence before approving a replacement, reproduction, refund or other remedy.

When you purchase a Citadel Atelier artwork, you acquire ownership of the physical copy delivered to you, subject to completion of payment and these Terms.

Ownership of a physical artwork is separate from ownership of the intellectual property embodied in that artwork.

Purchasing a work does not grant you copyright or a license to reproduce, manufacture, distribute or commercially exploit the image.

Except where otherwise stated or where rights belong to another identified rights holder, the artwork, designs, photographs, graphics, text, collection names, visual presentation, website content and other original material made available through Citadel Atelier are protected by applicable intellectual-property laws.

You may not reproduce, copy, modify, distribute, manufacture, sell, license, publish or commercially exploit protected Citadel Atelier material without prior authorization or another valid legal basis.

No purchase of a physical artwork transfers copyright or other intellectual-property rights unless a separate written agreement expressly states otherwise.

A purchased physical artwork may, of course, be displayed in your home, office or other lawful physical space.

Ownership does not authorize creation or sale of reproductions, merchandise, digital assets, prints, posters or derivative commercial products based on the artwork.

Subject to applicable law, ownership of a legitimate physical Citadel Atelier work generally allows the owner to transfer or resell that physical copy.

Resale does not transfer copyright or reproduction rights and must not falsely suggest sponsorship, authentication, partnership or affiliation beyond the provenance of the genuine physical work.

Citadel Atelier does not guarantee the future resale value, appreciation, investment performance or secondary-market liquidity of any artwork.

You may not alter, duplicate, fabricate or misuse Citadel Atelier Certificates of Authenticity, edition numbers, authentication information or other provenance documentation.

Any attempt to create unauthorized copies, duplicate certificates or falsely represent a reproduction as an authentic Citadel Atelier Museum Edition may violate our rights and applicable law.

Certain names, trademarks, products, cultural references or other third-party materials that may appear on or in connection with our website remain the property of their respective owners.

Reference to a third party does not by itself imply sponsorship, endorsement, partnership or affiliation with Citadel Atelier.

We make reasonable efforts to ensure that information presented on the website is accurate and current. Nevertheless, typographical, technical, photographic or other errors may occasionally occur.

We may correct errors, update information and modify website content when reasonably necessary, subject to our obligations concerning orders already accepted.

Product availability may change without notice. A work displayed on the website is not guaranteed to remain available indefinitely.

Limited editions may be withdrawn or permanently retired once their authorized edition has sold out.

We may also discontinue a work before sellout where reasonably necessary, provided we do not misrepresent the number of authentic editions already released.

Citadel Atelier artwork is offered for aesthetic, cultural and collecting purposes. Statements about rarity, limited editions or collectibility should not be interpreted as financial or investment advice.

We do not promise that any artwork will increase in value or generate a financial return.

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed as described in that policy, subject to applicable privacy law and your available privacy choices.

Our website and fulfillment operations rely on third-party services such as payment processors, production facilities, carriers, analytics providers and technology platforms.

We are not responsible for independent third-party services outside our reasonable control, although this does not limit any responsibility Citadel Atelier has to you that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, the website and its content are provided on an “as available” basis without warranties beyond those expressly stated or imposed by law.

Nothing in these Terms excludes warranties, consumer guarantees or other protections that cannot lawfully be excluded.

Nothing in these Terms limits liability where limitation or exclusion is prohibited by law, including any mandatory consumer rights that apply to your purchase.

To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful misuse of the website, infringement of intellectual-property rights, fraudulent conduct or material violation of these Terms.

We will not be responsible for delays or failures caused by events beyond our reasonable control to the extent permitted by applicable law.

Such events may include severe weather, natural disasters, war, civil disturbance, government action, customs disruption, labor disputes, carrier interruption, widespread network failures or other extraordinary circumstances.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
